Terms of service
Last updated: 25.09.2026
These terms govern the use of POSMI: the posmi.app website, the management panel at panel.posmi.app and the digital menus that restaurants publish with our service. They are an agreement between POSMI — whose details are on the Contact page — and the restaurant, bar or café that opens an account ("you" or "the customer"). By opening an account, starting a free trial or paying for a module you accept these terms on behalf of your business.
1. What POSMI is
POSMI is an online service for restaurants: a QR menu, ordering from the table, delivery and take-away, a waiter screen and a panel to manage the menu, orders, tables and staff. Together these make up the free plan, which has no expiry date and needs no card.
On top of it there are paid modules, subscribed to separately — Sales, Reputation and Guests — with the features, prices and conditions published on the Pricing page.
POSMI is not an invoicing system or a cash register: it does not issue tax receipts, is not integrated with ARCA (the Argentine tax authority) and does not replace your tax obligations.
Free tools on the site, such as the QR code generator (posmi.app/qr), are also governed by these terms where applicable.
2. Account, users and roles
A restaurant account is activated after you fill in the sign-up form and we contact you. The person requesting it confirms they are authorised to represent the business, and the account details — venue name, contact details, branches — must be true and up to date.
The account owner can add staff (managers, waiters, kitchen, host) and give each person a role with permissions and, where there are several branches, the branches they can access. You decide who gets in and what they see; you are responsible for what the people you invited do in the panel and for removing anyone who stops working with you.
There are no passwords: to sign in to the panel we email you a one-time access code from noreply@posmi.app. Keep that mailbox secure, because whoever controls it can get into your account. If you think someone has signed in without permission, write to us at once.
3. Free trial of the modules
Each paid module can be tried free for 30 days, once per restaurant and module.
To start the trial you add a card at the Dodo Payments checkout (section 5). Nothing is charged during the trial. We email you 3 days before it ends and, unless you cancel it from the panel, the first charge is made on day 30 and the subscription continues monthly.
If you cancel during the trial, nothing is charged: the module stays active until the end of the 30 days and is then switched off.
4. Subscription, prices and renewal
Modules are paid monthly, or upfront for 3 or 6 months with the discounts published on the Pricing page. Additional branches in the same panel carry their own monthly fee. The price you paid is fixed for the whole paid period.
A monthly subscription renews automatically every month. When a prepaid period ends, the subscription continues monthly at the current monthly price unless you cancel it before; we email you before it expires.
We update prices every three months and give 30 days' notice. The new price applies from the next renewal; if you paid upfront, your price does not change until the end of that period. If you disagree, you can cancel the module before the renewal.
If a charge fails (expired card, insufficient funds), the module is paused until the payment is settled. The free plan keeps working and no data is deleted.
5. Who charges you: Dodo Payments
Card payments are handled by Dodo Payments, our online reseller and Merchant of Record. Dodo Payments is the seller of record for the payment: it takes the payment, calculates and remits any sales tax, VAT or similar tax due on it, issues the receipt and handles disputes and chargebacks. On your card statement the charge appears as Dodo Payments, not as POSMI.
When you pay you also accept the Dodo Payments purchase terms shown at checkout. You enter your card details on the Dodo Payments page; they never pass through our servers.
The service itself is provided by us: everything in these terms about how it works, support, data and cancellation applies between you and POSMI.
6. Cancellation and refunds
You can cancel any module at any time from the panel or by writing to us. Cancelling stops the renewal: the module stays active until the end of the period already paid, and nothing more is charged. The free plan and your data remain available.
When and how a payment is refunded is explained in the Refund and cancellation policy.
You can also close the whole account by writing to us from the owner's email address. Section 8 explains what happens to the data.
7. Your content and published menus
With POSMI you publish your own content: the menu, dishes, photos, descriptions, prices, allergens and labels, promotions, events, logo and colours and, with the Reputation module, your own site on your own domain. That content is yours and you are responsible for it. You give us a free, non-exclusive licence to host it, display it and adapt it technically (for example, resize a photo), only to provide the service and only while the account is active.
By publishing, you confirm that:
- you own the rights to the photos, texts, logos and trademarks you upload, or hold a licence to use them;
- prices, dish ingredients, allergens and labels such as "gluten-free", "vegan" or "spicy" are correct and kept up to date — your guests decide based on them;
- you comply with the rules that apply to your business: consumer protection (including price display), food labelling, sale of alcohol, licences and advertising;
- the promotions, discounts, stamps and rewards you offer through POSMI are real and you will honour them on the terms you published.
You may not use POSMI to:
- sell or promote illegal products, medicines or controlled substances, or alcohol and tobacco to minors;
- publish misleading, discriminatory, violent or sexual content, content that infringes third-party rights, or impersonate another business;
- obtain fake or paid reviews, or offer rewards in exchange for positive reviews. The Reputation module invites happy guests to review you on Google and gives a guest with a problem a direct line to the manager, but it never prevents anyone from leaving a public review and must not be used to hide negative ones;
- send promotional messages to guests who have not consented to them;
- try to access other restaurants' accounts or data, overload the service, reverse-engineer it or resell it without our agreement.
We may hide content or suspend a menu that breaks these rules or the law, or that an authority or a rights holder asks us to remove. Unless it is urgent, we warn you first and give you the chance to fix it.
8. Your guests' data: data processing terms
With POSMI your restaurant collects data about its guests: name, phone or WhatsApp, email, birthday, orders and visits, reviews, favourites, stamps and points, and the notes your staff add about them. For that data the restaurant is the controller and POSMI acts as the processor — a provider of data processing services under Article 25 of Argentine Law 25.326. We undertake to:
- process that data only to provide the service and on your instructions — these terms and what you configure in the panel — and never for our own purposes, our own advertising or for sale;
- keep it confidential and give access only to staff who need it to run the service and support you;
- protect it with reasonable security measures such as encrypted traffic (HTTPS) and role-based access;
- use only the sub-processors the service needs — the server provider hosting the platform, Cloudflare for DNS and protection, and Brevo for sending email — and require equivalent protection from them; the current list is in the Privacy policy;
- help you answer your guests' requests for access, rectification or deletion; if one reaches us directly, we forward it to you;
- tell you without undue delay if we detect a security incident affecting that data;
- when you close the account, give you a copy of the data if you ask and delete it within 90 days, except what the law requires us to keep.
As controller, you undertake to have a legal basis for every piece of data you enter (for example, a guest's consent to receive promotions or birthday greetings), to inform your guests about the processing and to comply with Law 25.326 and, where applicable, the laws of other countries.
We may use aggregated, anonymous data that identifies neither a guest nor your restaurant to measure and improve the service.
9. Availability and support
We work to keep POSMI available at all times, but we cannot guarantee uninterrupted operation: there may be maintenance and failures of providers or connectivity. When planned maintenance affects the service, we try to do it at quiet hours and to let you know in advance.
We may improve and change features. If we remove a core feature of a module you are paying for, you may cancel it and we refund the unused part of the period.
Support is by email and, where available, WhatsApp; the details and response times are on the Contact page.
10. Intellectual property
The software, design, the POSMI brand and documentation are ours. While your account is active we give you a non-exclusive, non-transferable right to use them. Your content remains yours (section 7).
If you send us suggestions, we may use them to improve the service with no obligation to compensate you.
11. Liability
The restaurant is solely responsible for its menu, its prices, preparing and delivering orders, serving its guests and its tax obligations. POSMI is not a party to the relationship between the restaurant and its guests.
To the extent the law allows, our total liability to you is limited to what you paid us in the 12 months before the event giving rise to it, and we are not liable for lost profit, lost sales or data, or indirect damage. None of this limits liability that the law does not allow to be limited, or your rights as a consumer under Argentine Law 24.240.
You agree to hold us harmless from third-party claims arising from your content, from data you entered without a legal basis or from a breach of these terms.
12. Suspension and closure
We may suspend or close an account that seriously breaches these terms, uses the service for fraud or puts other users or the platform at risk. Unless it is urgent, we warn you first and give you reasonable time to fix the problem. If we close your account without any breach on your part, we refund the unused part of the periods paid.
13. Changes to these terms
We may update these terms. The current version is always on this page with its date. If a change materially affects you, we email you at least 30 days in advance; if you disagree, you can cancel the modules before it takes effect and we refund the unused part.
14. Governing law and disputes
These terms are governed by the laws of the Argentine Republic. Before any claim, write to us: most problems are solved by email within a few days. If we cannot agree, the courts with jurisdiction under Argentine law will decide, without prejudice to any rights you have under consumer protection law.
Disputes about a card charge are handled by Dodo Payments as Merchant of Record; see the Refund and cancellation policy.
